Terms and Conditions<\/strong><\/h2>\n

1. Introduction<\/strong><\/h3>\n

Welcome to Juspropa. These Terms and Conditions (\"Terms\") govern your use of our platform, services, and any content provided by Juspropa. By accessing or using Juspropa, you agree to comply with these Terms. These Terms may be updated periodically, and your continued use signifies acceptance of any changes.<\/p>\n

2. Scope of Work<\/strong><\/h3>\n

a) Services Provided:<\/strong> Juspropa offers a range of home and office improvement services, including but not limited to solar installations, electrical work, plumbing, carpentry, painting, handyman services, kitchen and bathroom renovations, tiling, and appliance repairs. Our professionals are skilled, experienced, and qualified.<\/p>\n

b) Modification of Work:<\/strong> No modifications to the existing structure will be made without prior consent from the client. Existing structural fittings will be used unless otherwise agreed upon in advance.<\/p>\n

c) Labor and Tools:<\/strong> Juspropa will provide all necessary labor and tools for the job, ensuring exceptional service.<\/p>\n

3. Custom-Made, Cut-to-Size & Installation Acknowledgement<\/strong><\/h3>\n

Certain installations require products or materials to be measured, cut, trimmed, drilled, machined, routed, shaped, or otherwise permanently modified to achieve the required fit. By approving the quotation and authorising Juspropa to proceed with the installation, the Client acknowledges, understands, and agrees to the following:<\/p>\n

a) Permanent Modification of Materials<\/strong><\/p>\n

Where a product requires cutting, trimming, drilling, machining, routing, or any other permanent modification, the Client acknowledges that such alterations are irreversible.<\/p>\n

Once any door, frame, panel, countertop, skirting, flooring, cabinetry, moulding, or any other material has been cut or customised, it cannot be restored to its original manufacturer condition or dimensions and may no longer qualify for return, exchange, or replacement by the supplier or manufacturer.<\/p>\n

The Client expressly authorises Juspropa to carry out all necessary modifications required to complete the installation in accordance with accepted industry standards.<\/p>\n

\n

b) Standard Industry Installation Practices<\/strong><\/p>\n

All measurements, cutting, trimming, machining, drilling, fitting, adjustments, and installation work shall be carried out using recognised industry practices, appropriate tools, and reasonable workmanship standards applicable to the particular installation.<\/p>\n

Minor adjustments made during installation shall not constitute defective workmanship where they are necessary to achieve the most suitable fit.<\/p>\n

\n

c) Inherent Risks Associated with Customisation<\/strong><\/p>\n

The Client acknowledges that customising materials carries inherent risks which cannot always be eliminated, even where reasonable care and skill are exercised.<\/p>\n

Certain products may contain hidden defects, internal stresses, manufacturing weaknesses, voids, knots, inconsistent grain patterns, brittle finishes, laminate imperfections, veneer defects, or other characteristics that only become apparent during the cutting or installation process.<\/p>\n

Accordingly, the Client accepts that minor chipping, splintering, cracking, edge damage, laminate lifting, veneer separation, loose sections, or similar occurrences may arise as a natural consequence of customising the material.<\/p>\n

Where such occurrences arise naturally during the customisation process and are not caused by the negligence, recklessness, or intentional misconduct of Juspropa or its technicians<\/strong>, Juspropa shall not be held liable for the repair, replacement, reimbursement, or compensation relating to the affected material.<\/p>\n

\n

d) Restoration of Modified Components<\/strong><\/p>\n

Certain doors or timber products may require sections to be removed during installation.<\/p>\n

Where reasonably possible, loose or separated components may be restored using suitable adhesives, fillers, approved fixings, or other accepted industry repair methods.<\/p>\n

Such restoration forms part of a normal installation process and shall not, in itself, constitute defective workmanship.<\/p>\n

\n

e) Existing Site Conditions<\/strong><\/p>\n

Juspropa performs installations based on the existing conditions found at the property.<\/p>\n

Juspropa shall not be responsible for operational, alignment, clearance, or cosmetic issues resulting from pre-existing site conditions, including but not limited to:<\/p>\n

    \n
  • Uneven, sloping, damaged, or unlevelled floors.<\/li>\n
  • Walls that are not straight, plumb, level, or square.<\/li>\n
  • Door frames that are twisted, bowed, warped, damaged, or out of alignment.<\/li>\n
  • Existing structural movement or settlement.<\/li>\n
  • Previous alterations or defective workmanship carried out by others.<\/li>\n
  • Existing building tolerances that prevent perfect alignment.<\/li>\n<\/ul>\n

    Accordingly, Juspropa shall not be liable where:<\/p>\n

      \n
    • A door cannot open to its maximum intended swing because of an uneven or sloping floor.<\/li>\n
    • A door requires reduced clearance to prevent rubbing against the floor.<\/li>\n
    • A door appears skew, uneven, or has inconsistent gaps because the existing frame is not square or plumb.<\/li>\n
    • Additional trimming or adjustments are necessary due to existing building conditions.<\/li>\n<\/ul>\n

      Rectification of existing structural defects, floor levelling, frame replacement, wall straightening, or any similar remedial work falls outside the agreed quotation unless specifically included in writing.<\/p>\n

      \n

      f) No Automatic Admission of Liability<\/strong><\/p>\n

      The lodging of a complaint does not automatically establish liability on the part of Juspropa.<\/p>\n

      No technician, employee, subcontractor, or representative of Juspropa is authorised to admit liability, agree to replace products, authorise reimbursement, or promise compensation without the matter first being investigated in accordance with this clause.<\/p>\n

      \n

      g) Independent Assessment<\/strong><\/p>\n

      Where the Client is dissatisfied with any installation, workmanship, customised material, or cut product, Juspropa shall be afforded a reasonable opportunity to inspect and investigate the matter before any repair, replacement, refund, reimbursement, or admission of liability is considered.<\/p>\n

      Where necessary, Juspropa may remove the affected product and submit it to the original manufacturer, supplier, distributor, or another suitably qualified independent expert for technical assessment.<\/p>\n

      Juspropa may also appoint independent inspectors, engineers, manufacturers, qualified installers, quantity surveyors, building inspectors, material specialists, or any other appropriately qualified professionals to conduct an impartial evaluation of both the installed product and the site conditions.<\/p>\n

      The purpose of the investigation shall be to determine whether the reported issue resulted from:<\/p>\n

        \n
      • A manufacturing defect;<\/li>\n
      • Hidden or latent defects within the material;<\/li>\n
      • Normal risks associated with customisation;<\/li>\n
      • Existing building or site conditions;<\/li>\n
      • Incorrect use or misuse after installation;<\/li>\n
      • Fair wear and tear;<\/li>\n
      • External causes beyond Juspropa's control; or<\/li>\n
      • Defective workmanship.<\/li>\n<\/ul>\n

        The findings of such investigation shall be taken into account before determining whether Juspropa bears responsibility for the reported issue.<\/p>\n

        \n

        h) Client Cooperation During Investigation<\/strong><\/p>\n

        The Client agrees to provide Juspropa with reasonable access to the property to conduct inspections and investigations.<\/p>\n

        The Client shall not remove, alter, repair, replace, or permit any third party to interfere with the installed product before Juspropa has had a reasonable opportunity to complete its assessment.<\/p>\n

        Any unauthorised alterations or repairs may compromise the investigation and may affect or invalidate any claim.<\/p>\n

        \n

        i) Remedies<\/strong><\/p>\n

        Where an investigation establishes that Juspropa is responsible for defective workmanship or negligence, Juspropa shall, subject to applicable law, determine the appropriate remedy, which may include repairing the work, replacing the affected component where reasonably possible, or providing another appropriate remedy.<\/p>\n

        Where the investigation determines that the reported issue resulted from existing site conditions, manufacturing defects, hidden defects within the material, misuse, or the normal risks associated with customisation, Juspropa shall not be liable for replacement costs, reimbursement, compensation, or consequential losses.<\/p>\n

        \n

        j) Good Faith and Fair Resolution<\/strong><\/p>\n

        Both the Client and Juspropa agree that all complaints shall be handled fairly, transparently, and in good faith.<\/p>\n

        Neither party shall assume liability or entitlement without first allowing a reasonable investigation to establish the facts.<\/p>\n

        The purpose of this clause is to ensure that decisions are based on objective evidence and independent assessment, so that neither the Client nor Juspropa is unfairly prejudiced or unjustly enriched at the expense of the other.<\/p>\n

        4. Duration of Work<\/strong><\/h3>\n

        a) Estimated Duration:<\/strong> Work duration is subject to job logistics. While Juspropa will strive to complete the work within the estimated timeframe, specific completion dates cannot be guaranteed.<\/p>\n

        b) Delays:<\/strong> Delays caused by the client, such as late delivery of materials or unforeseen circumstances, may extend the completion date.<\/p>\n

        5. Health and Safety<\/strong><\/h3>\n

        a) Regulations:<\/strong> Juspropa adheres to all relevant health and safety regulations.<\/p>\n

        b) Client Responsibility:<\/strong> The client must provide a safe and secure working environment for the Juspropa team.<\/p>\n

        6. Warranties and Liabilities<\/strong><\/h3>\n

        a) Workmanship Warranty:<\/strong> Juspropa offers a 12-month warranty on workmanship.<\/p>\n

        b) Liability for Damages:<\/strong> Juspropa is not liable for damages or losses related to invisible plumbing, electrical systems, or unforeseen issues resulting from drilling, cutting, or digging.<\/p>\n

        c) Customer Satisfaction:<\/strong> Juspropa offers a Guaranteed Happiness Policy. If you are not satisfied with the service, we will work to meet your expectations, and if not, a full refund will be processed.<\/p>\n

        7. Payment Terms<\/strong><\/h3>\n

        a) Fees:<\/strong> Additional work will be billed separately, and payment must be made before or after the job. Proof of Payment is required before the Juspropa team leaves the site.<\/p>\n

        b) Materials:<\/strong> The client supplies all necessary materials for the job or Juspropa will provide all the materials depending on the nature of the agreement.<\/p>\n

        c) Retention of Ownership and Right of Removal<\/strong><\/p>\n

        All materials, equipment, and goods supplied and installed by Juspropa remain the sole property of Juspropa until full payment of the total invoiced amount has been received and cleared in our bank account.<\/p>\n

        Payment shall be due within seven (7) calendar days from the date of installation, unless otherwise agreed in writing.<\/p>\n

        In the event of non-payment after the due date, Juspropa reserves the right, upon providing reasonable written notice, to enter the premises during reasonable hours to remove any materials, equipment, or goods that remain unpaid. The client hereby consents to such access and acknowledges that this clause forms part of the agreement between the parties.<\/p>\n

        Should removal become necessary due to non-payment, the client shall be liable for all reasonable costs incurred by Juspropa, including but not limited to:<\/p>\n
